OVERVIEW

Welcome to QART. The terms “we”, “us” and “our” refer to QART. QART operates this store and website, including all related information, content, features, tools, products and services (the “Services”). QART is powered by Shopify, which enables checkout and commerce functionality. These Terms, together with any policies referenced herein, describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use or access our Services.

SECTION 1 - ACCESS

By using the Services, you represent that you are at least the age of majority where you live. To use the Services, including placing an order, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide this information.

SECTION 2 - OUR PRODUCTS

We have made every effort to provide an accurate representation of our products and services. Colors or product appearance may differ depending on your device and settings. Exact color matching is not guaranteed. Slight color variations are acceptable, are not considered a production mistake, and are not eligible for refund, return, or reproduction. All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities offered to any person, geographic region or jurisdiction on a case by case basis.

SECTION 3 - ORDERS

  • When you place an order, you are making an offer to purchase.

  • QART reserves the right to accept or decline your order for any reason at its discretion.

  • Your order is accepted once payment is processed and the order is confirmed.

  • Please review your order carefully before submitting.

  1. Cancellations and changes

If you need to cancel or change an order, contact us immediately.

  • If your order has not entered production yet, we may be able to cancel it and refund you to the original payment method.

  • If your order has entered production, we cannot guarantee cancellation or changes.

  • If an order is canceled after production has started, the refund may be full or partial depending on what production was completed and whether the order has shipped and been retrieved by the carrier.

  1. Personal use only

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING

  • Prices, discounts and promotions are subject to change without notice.

  • The price charged for a product will be the price shown at checkout at the time the order is placed and will be set out in your order confirmation.

  • Unless otherwise expressly stated, posted prices do not include taxes and shipping, which are calculated at checkout where applicable.

  • You agree to provide current, complete and accurate purchase and payment information for all purchases made at our store.

SECTION 5 - SHIPPING AND DELIVERY

  1. Shipping coverage

We currently serve US customers only.

  1. Shipping cost
  • Shipping is $2.99 per order.

  • Orders over $100 ship free.

  1. Timeline
  • Most orders are produced and shipped in about 1 to 2 business days.

  • After shipment, delivery typically takes another 3 to 5 business days.

  • All delivery times are estimates only and are not guaranteed.

  1. Tracking

Tracking information is provided once your order ships.

  1. Risk of loss
  • Once we transfer products to the carrier, title and risk of loss passes to you.

  • We are not responsible for delays caused by shipping carriers or events outside our control.

  1. Delivered but missing, and lost shipments
  • If tracking shows delivered but you cannot find the package, you may need to file a claim with the carrier.

  • We will help, but we cannot automatically refund or replace orders marked delivered.

  • If the carrier confirms the shipment was lost in transit, contact us and we will make it right.

SECTION 6 - RETURNS, REFUNDS, AND REPLACEMENTS

  • Your purchases are subject to our Refund Policy.

  • Because prints are made to order and custom, print sales are final and we do not accept returns or exchanges.

  • If your print arrives damaged, defective, or incorrect, contact us with:

    • Your order number

    • Clear photos of the print

    • Clear photos of the packaging, including any visible damage

  • If the issue is confirmed and deemed a production or packing issue, we will replace the print at no cost and reship it using the same shipping method. To qualify for a replacement, notify us within 30 days of delivery.

SECTION 7 - INTELLECTUAL PROPERTY

  • Our Services, including all content, images, artwork, text, and design, are owned by QART or its licensors and are protected by intellectual property laws.

  • Purchasing a print does not grant any right to reproduce, distribute, modify, or commercially exploit the artwork.

SECTION 8 - OPTIONAL TOOLS

  • We may provide access to tools offered by third parties.

  • You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties, representations or conditions of any kind and without any endorsement.

  • Any use by you of optional tools offered through the site is entirely at your own risk.

SECTION 9 - THIRD-PARTY LINKS

  • The Services may contain links to third-party websites.

  • We are not responsible for third-party content, policies, or practices. If you leave our Services, you do so at your own risk.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

QART is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with QART. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and QART, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with QART.

SECTION 11 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy.

SECTION 12 - DISCLAIMER OF WARRANTIES

Except as expressly stated by QART, the Services and all products are provided “as is” and “as available” without any warranties, to the fullest extent permitted by law.

SECTION 13 - LIMITATION OF LIABILITY

To the fullest extent provided by law, QART will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or products.

SECTION 14 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless QART and its service providers from losses or claims arising out of your breach of these Terms or misuse of the Services.

SECTION 15 - GOVERNING LAW

These Terms are governed by the laws of the Socialist Republic of Vietnam. Any dispute will be submitted to the competent courts in Ho Chi Minh City, Vietnam. If you are a consumer, nothing in these Terms limits any rights you may have under mandatory consumer protection laws that apply to you.

SECTION 16 - CHANGES TO TERMS

We reserve the right to update or replace any part of these Terms by posting updates on this page and updating the “Last updated” date. Your continued use of the Services following changes constitutes acceptance of those changes.
